John Langan is the Managing Partner of Barclay Damon, having served in that role since 2000. During his time in leadership, John has guided the firm’s growth from 50 to 275 lawyers and its transformation from a regional firm with three offices to a unique platform of smaller and major market offices from which a number of featured practices, such as Energy and Intellectual Property, are growing in national prominence.

John serves a large roster of clients as an experienced business trial lawyer. In both state and federal courts, John represents corporate and individual clients in a wide array of business disputes involving fraud, breach of contract, and tort liability exposure. John draws upon his early training as a project finance lawyer on Wall Street, and later experience as a trial lawyer with a prominent New York City firm, to help clients navigate through today’s challenging business environment. Clients find John’s training, combined with his real-life business experience in helping to build and lead a 425-person organization, to be valuable in advising them and representing their legal and business interests.

John is a resident of the Syracuse Office and spends considerable time among all the offices of the firm. John is active in the local community, serving on a number of association boards from time to time, as well as serving the U.S. District Court for the Northern District of New York's Federal Court Bar Association as a founding trustee and past president. John is also a regular contributor on law firm trends for Of Counsel magazine.

Representative Experience

  • Lead counsel in a number of high profile cases investigating and prosecuting fraud and employee theft for publicly traded and privately held companies including CFO embezzlement scheme for public energy equipment manufacturer, multiple vendor and employee theft cases for public utility, controller defalcation of financial records for a large privately held medical device manufacturer; also served as secondary counsel in case in New York City involving ring of employees scheme to defraud during leveraged buy-out of national publishing house.
  • Multiple matters pursuing civil claims and criminal referrals for premium theft and conversion by insurance agents on behalf of national insurance companies.
  • Handled numerous theft of trade secret cases testing the validity and scope of restrictive covenants in business contracts including representing a regional construction equipment supplier, a technology-based manufacture of residual gas analyzers and particle detectors, and an energy marketing company.
  • Prevailed as lead counsel in well publicized breach of contract dispute among two major New York Public Utilities over operating rights to the Nine Mile II Nuclear Power Plant.
  • Obtained a permanent injunction on behalf of a NYS Power Authority against a real estate developer over easement rights related to a major transmission/distribution line.
  • Prosecuted a breach of contract claim on behalf of the State of New York over issues related to a well-respected gaming facility operator.
  • Prosecuted and defended numerous businesses related to Lanham Act claims including defending an Indiana corporation engaged in the manufacture of Adirondack chairs against claims of trademark and trade dress infringement, prosecuting claims of trademark infringement for foundation protecting the well known Roycroft “arts & crafts” trade name and marks,” representing regional tanning bed company in protection of its trade name, and representing regional grocery store in the New York metropolitan area against misuse of its name and mark.
  • Represented national entertainment company in prosecuting claims of copyright infringement related to release of the Batman Movie series.
  • Defended a prominent Upstate New York municipality in an Article 78 challenge to the issuance of a special permit for the siting and construction of an urgent care hospital.
  • Represented majority and minority shareholders in hotly contested corporate shareholder disputes in a wide array of industries including construction, mobile home loan financing, insurance brokerage, investment advising, and for the well-known New York City “Bronx Terminal Market” near Yankee Stadium.
  • Defended successfully at trial a British company manufacturing roofing systems against product liability claims before a South Carolina jury.
