James Domagalski is a partner in the firm’s Buffalo Office and is an experienced trial lawyer in both federal and state courts and before administrative agencies. Jim’s trial experience includes large construction disputes, complex commercial and municipal litigation and employer defense and counseling in labor, employment and discrimination matters. Jim serves as the Chair of the firm’s Construction & Surety Practice Area.

A longtime community leader in Western New York, Jim has served in numerous civic and charitable leadership positions and is the former Chairman of the Erie County Republican Party.

Representative Experience

  • Represented the federal government in a major lease dispute arising from a federal statute enacted relating to the savings and loan crisis.
  • Defending municipalities and law enforcement in class-action law suits involving search and seizure claims.
  • Represented an engineering firm regarding a construction cost overrun dispute involving a major redesign and construction of a steel blast furnace.
  • Represented a specialty contractor in a construction dispute involving a domed roof at Montreal Olympic Stadium.
  • Defended a contractor and defeated a construction defect and mold claim brought by an owner regarding a university housing construction project.
  • Represented municipalities and contractors in construction disputes involving large public projects, including sewage treatment plants, historic renovations and airport and highway projects.
  • Represented a private equity investment firm in a significant contract dispute.
  • Counseling a large regional retail enterprise on employment law issues and defending the company in court and before administrative agencies.
  • Defending municipalities regarding claims brought against government and law enforcement.
  • Representing a manufacturer on employment law and safety issues at two large manufacturing facilities.
  • Representing universities and other higher education institutions in construction contract, project and litigation matters.
