Addition of New Partners Expands Barclay Damon’s New York City Office
NEW YORK CITY, NY — January 3, 2017 — Barclay Damon announces two new partners, J. Joseph Bainton and John C. Canoni, have joined the law firm’s New York City office.
J. Joseph Bainton is a commercial litigator with over 40 years of experience representing public and private clients in intellectual property, professional liability and insolvency claims, including fraudulent transfer and alter-ego claims. Mr. Bainton is a graduate of Rutgers School of Law and will join the firm’s Commercial Litigation and Intellectual Property Litigation Practice Areas.
John C. Canoni is a litigator with over 20 years of experience in complex commercial litigation. He is a graduate of Amherst College and Fordham University School of Law and will join the firm’s Commercial Litigation and Mass & Toxic Torts Practice Areas.
Mr. Bainton has supervised on a nation-wide or regional basis the defense of product liability claims for manufacturers in diverse industries. His seminal work includes establishing the right of intellectual property owners to ex parte injunctive relief; the right of intellectual property owners to recover damages for violations of injunctions as a matter of right and not judicial discretion; the right of a prospective trademark user to obtain declaratory relief regarding non-infringement of a mark prior to actual use of the mark in commerce; and the propriety of subjecting recidivist counterfeiters to criminal prosecution in the name of the United States by attorneys specially appointed by district courts. In commercial litigation, he has defended a public company that reported in its SEC filings potential liabilities in excess of $500 million and represented a bankruptcy trustee who recovered in excess of $350 million. Mr. Bainton has represented clients in courts across the country, including in Portland, Maine; San Diego; Seattle; and Miami, in courts that include the Supreme Court of the United States, the New York Court of Appeals, and the U.S. Courts of Appeal for the First, Second, Third, Seventh, Ninth, Tenth, Eleventh and District of Columbia Circuits.
Mr. Canoni has represented manufacturing, automotive, pharmaceutical, chemical, consumer goods, financial services and insurance companies in a broad range of products liability, corporate governance, real estate, banking, securities and other commercial litigation matters. He has successfully tried cases before juries in state and federal courts and argued before state and federal appellate courts.
