Rob Thorpe Interviewed for News 12 Brooklyn Segment on BCake NY Website Accessibility Lawsuit

Rob Thorpe, partner, was interviewed by News 12 Brooklyn for a segment about the website accessibility lawsuit filed against BCake NY, a bakery in Prospect Heights. The bakery was sued by a blind man who claimed their website wasn’t accessible to him, thereby violating the Americans With Disability Act (ADA). BCake NY said they conduct regular audits to ensure their website is ADA compliant.

The segment cited an alert Rob authored about the plaintiff, who has filed at least 20 lawsuits since November 30, 2023. About how so many lawsuits can be filed, Rob said, “There are technical standards under the ADA for places of public accommodation. Wheelchair ramps, a number of handicapped parking spaces, your doorway has to be a certain width wide. That's all contemplated under the ADA and has been elaborated on, but in the context of website accessibility for private businesses, the Department of Justice hasn’t adopted a standard.”
