Biography

Joe serves as Barclay Damon's Commercial Litigation & Complex Trials Practice Area co-chair. With over 30 years of legal experience, Joe has tried cases in both federal and state courts, arbitrated and mediated cases before the American Arbitration Association and other tribunals, and argued before both federal and state courts of appeal. Joe also regularly advises clients on how to best achieve their business goals through the avoidance of litigation.

Joe concentrates his practice on complex business disputes, including patent, copyright, trademark, and trade secret litigation; unfair competition and noncompete agreement suits; technology license and software development disputes; and private company shareholder disputes.

  • Represents a global supplier of laser and photonics solutions for precision manufacturing in trade secret and competition disputes.
  • Represented a major medical device manufacturer and its key clinical employee, defending against competition claims.
  • Represented a leading life sciences company in a dispute with a competitor and university licensor to establish exclusivity of a patent license.
  • Represented a food packaging manufacturer in enforcing patent rights relating to aseptic bottling in multiple infringement actions with domestic and international competitors.
  • Represented a leading medical device manufacturer enforcing patents relating to infusion pump technology against a competitor.
  • Represented a European pharmaceutical company in a patent license dispute with a US licensor/debtor in bankruptcy.
  • Represented a cable-parts manufacturer in patent infringement and false-advertising suits against competitors.
  • Represented the owner of multiple news websites in a nationally publicized copyright and trademark infringement action against a prominent media organization.
  • Represented a medical equipment manufacturer in claims of trade secret misappropriation and unfair competition against former employees and a competitor.
  • Represented an inventor of a computer antivirus technology in claims against a leading antivirus software manufacturer.
  • Represented a major data storage manufacturer against software-maintenance service provider in connection with copyright, DMCA, and patent claims.
  • Represented a major data storage manufacturer defending against patent infringement claims brought by a non-practicing holding company.
  • Represented a leading provider of navigation software to the trucking industry in a lawsuit resulting from unraveling acquisition of a competitor.
  • Represented a Vietnam War veteran on a pro bono basis in obtaining a military discharge upgrade based on a PTSD diagnosis, which was not a recognized diagnosis at the time of discharge.
