Biography

With over 40 years of legal experience, Harry primarily concentrates his practice on complex business- litigation matters. Harry has successfully represented clients in jury and bench trials in Massachusetts state and federal courts and in administrative proceedings and arbitrations, handling issues involving contract disputes, trade secrets, confidential information and non-competition covenants, products liability, partnership disputes, wrongful termination, and employment discrimination.

Harry was the first person of African descent to be named partner in a major Boston firm, WilmerHale.

Experience

Representative Experience

  • Successfully defended a mutual-fund advisor in a merger litigation.
  • Represented a breast-implant manufacturer in a case that changed Massachusetts law regarding implied warranty duty to warn.
  • Obtained a jury verdict for the defense in an asbestos property-damage litigation.
  • Obtained awards for an automobile manufacturer in dealer-termination arbitrations.
  • Obtained jury verdicts and favorable appellate decisions in personal-injury and property-damage actions against a municipal water and sewer agency.
  • Represented former employers in successful trade-secret claims against former employees.
  • Obtained defense jury verdicts in employment-discrimination actions against an investment management company, federal reserve bank, life insurance company, and toy and games manufacturer.
  • Successfully represented a defendant and counterclaim plaintiff in breach of contract and unfair business practice litigation.
  • Represented a private university in connection with age discrimination and related state law claims brought by a former professor. The district court dismissed the claims, and the First Circuit affirmed. In its summary affirmance, the First Circuit agreed that the plaintiff’s wrongful termination claims were time barred. The First Circuit also found that the plaintiff failed to demonstrate error as to the district court’s conclusion that any failure-to-hire claim had not been properly exhausted and failed to state a plausible claim of retaliation. The court further affirmed dismissal of the state law claims on the grounds that they should not be discretionarily entertained and for the appellant’s failure to establish the requisite amount in controversy.
