Barclay Damon's NYC Office Lands Accomplished Bankruptcy Partner From Faegre Drinker

January 6, 2022—Barclay Damon announces Keith Costa, former Faegre Drinker bankruptcy partner, has joined Barclay Damon’s growing Restructuring, Bankruptcy & Creditors’ Rights Practice Area and expanding New York City office. He is also a member of the firm’s White Collar & Government Investigations Practice Area and Health & Human Service Providers Team. While Costa’s primary office location is New York City, he will take advantage of the firm’s 14-lawyer New Haven office when needed. 

Costa has over three decades of experience as a bankruptcy and corporate restructuring lawyer. He represents debtors and creditors, both secured and unsecured, in proceedings of all types nationwide. Costa’s experience includes commercial litigation and handling reorganizations, out-of-court workouts and debt restructurings, and private equity firm acquisition of distressed debt and assets. He has served as a court-appointed Chapter 11 trustee and examiner and in other fiduciary-related roles, including as counsel to official committees of unsecured creditors and as special counsel to boards of directors, throughout the country. 

Additionally, Costa is a court-certified mediator for the US bankruptcy courts in the Southern District of New York and Delaware. He has served as a mediator and arbitrator for high-profile bankruptcy cases, including the Madoff and Lehman Brothers bankruptcy cases.

Prior to joining Barclay Damon and working at Faegre Drinker, Costa was a partner at top New York City business law boutique Otterbourg PC. He also served for 10 years as an assistant United States trustee for the Southern District of New York under United States Trustee Arthur J. Gonzalez, where he was involved in some of the largest and most complicated bankruptcy cases ever filed.
