Barclay Damon Lands Former New York Utility Senior In-House Counsel Ben Falber

Barclay Damon announces Ben Falber has joined Barclay Damon as a partner in the firm’s Regulatory and Energy Practice Areas. His primary office location is New York City.

Falber brings over a decade of experience advising on complex regulatory matters within the energy sector. Most recently, he served as senior in-house counsel at a major utility serving New York. In this role, Falber regularly appeared before the New York Public Service Commission (PSC) in a variety of proceedings, including long-term resource planning, retail access, pole attachments, community choice aggregation, ratemaking, and numerous other regulatory and energy policy-oriented proceedings, and provided counsel to the utility’s senior leadership. He also served as senior in-house counsel as well as senior project manager at the New York State Energy Research and Development Authority (NYSERDA).

Falber’s addition bolsters Barclay Damon’s capabilities in representing clients across regulatory, compliance, and litigation matters in the energy industry. “Ben’s experience provides our clients with an invaluable perspective on navigating regulatory challenges,” said Brenda Colella, Barclay Damon’s Regulatory Practice Group leader. “His firsthand experience with both the regulatory process and policy-making decisions allows him to anticipate regulatory shifts and strategize effectively for our clients. Ben’s insights into agency dynamics and his ability to advocate across complex compliance landscapes will be a tremendous asset as we continue to support clients in advancing their energy initiatives.”

“Ben’s deep knowledge of the regulatory landscape and his track record of navigating complex energy matters will bring tremendous value to our clients,” said Rick Capozza, Barclay Damon’s Energy Practice Area chair. “As we continue to expand our Energy Practice Area, Ben’s experience and strategic approach align perfectly with our commitment to providing top-tier legal solutions for today’s evolving energy market.”

In his role as senior in-house counsel at NYSERDA, Falber oversaw legal strategy for the agency’s innovation and clean transportation programs. His work included managing multimillion-dollar procurements and addressing risk for high-profile energy projects. Falber additionally served as a senior project manager and oversaw the development and implementation of groundbreaking distributed energy resource programs. Falber’s background positions him uniquely to help clients navigate regulatory issues and achieve their business objectives in the dynamic energy landscape.

“I am excited to join Barclay Damon and to contribute to the firm’s well-established Regulatory and Energy Practice Areas,” Falber said. “As regulatory requirements and market demands continue to evolve, I look forward to helping the firm’s clients address these changes and achieve sustainable growth.”
