The article provides best practices for banks to minimize litigation risks from the onset and how to address them when they arise:

  • Common sense is not that common.
  • Treat your legal counsel as counsel.
  • No two banks are the same.
  • Communication is key.
  • Be boring, but be human.
  • Identify the issues.
  • Less may not be more.
  • Admit mistakes. The cover-up often really is worse than the “crime.”
