On Sunday, Governor Andrew Cuomo issued Executive Order 202.13, which ordered that, effective immediately, all in-person business restrictions will be continued through April 15 unless otherwise extended by a future executive order. The executive order also extends the following suspensions and modifications until April 28:
- The grace period for the payment of premiums and fees for any life insurance policyholder or fraternal benefit society certificate holder has been extended to 90 days.
- A moratorium on insurers cancelling, non-renewing, or conditionally renewing any workers’ compensation insurance policy issued to an individual or small business for 60 days
Relatedly, courts throughout the state—including Suffolk County and the Seventh and Fifth Judicial Districts—will move toward virtual court proceedings for all essential court activities. For virtual court proceedings, the parties, judges, court reporters, etc. will participate by videoconference. A minimal core team of staff will remain at each courthouse to manage technology, facilitate the proceedings, and conduct necessary court functions. This approach models the virtual court protocol that was recently implemented in New York City’s Criminal and Family Courts.
Barclay Damon LLP will continue to keep you advised on further modifications and suspensions in New York State that affect litigated matters.
