Jack Weider concentrates his practice on providing business and strategic advice to companies in turnaround situations; representing business owners, large and small businesses, healthcare facilities, official creditors’ committees, secured creditors, institutional lenders, shareholders committees, and fiduciaries in bankruptcy reorganizations, workouts and commercial litigation matters. He is also available as a mediator and an arbitrator in commercial and tort matters.

With over 40 years experience, Jack previously was the Chair of the Financial Reorganization and Bankruptcy Practice Group at Harter Secrest & Emery LLP.  

Representative Experience

  • Successfully representing institutional secured creditors, businesses, and healthcare facilities in out-of-court workouts and Chapter 11 cases in the Western, Northern, Southern and Eastern Districts of New York
  • Restructuring and foreclosing real estate projects including golf courses, residential developments, regional outlet malls and shopping centers
  • Successfully reorganizing a large hospital in Central New York under Chapter 11 of the Bankruptcy Code in a case believed to be the first in the country where a sizeable hospital had been successfully reorganized without the hospital’s sale or merger, and advising healthcare organizations regarding financial restructuring
  • Serving as US creditors’ committee counsel in the Laidlaw cross-border cases dealing with some $2.5 billion of unsecured debt; additional committee engagements include the case of a 90-store supermarket chain with unsecured debt in excess of $100 million, and the case of multi-state auto parts chain in which a major source of unsecured creditor recovery resulted from claims asserted against an affiliate
  • Obtaining confirmation of Chapter 11 reorganization plans for both publicly and closely held corporations such as technology companies and sponsoring and obtaining confirmation of creditors’ plans
  • Representing buyers, sellers, and creditors in sales of distressed businesses and nursing homes through Chapter 11 cases, UCC Article9 sales, and out-of-court transactions
  • Developing strategy as senior bankruptcy lawyer on a team that represented 15 secured institutional lenders in the Chapter 11 cases of The Bennett Funding Group, Inc. and certain affiliates, which debtors owed more than $1 billion and reportedly ran the biggest Ponzi scheme in U.S. history until the Madoff case
  • Defending bankruptcy preference claims asserted in national and local cases, as well as trustees pursuing such claims
  • Advising businesses and landlords in negotiating bankruptcy clauses and provisions of contracts, agreements and leases
  • Representing institutional lenders in contested seizures of business assets and the enforcement of commercial loan transactions
