Gretchen Aylward focuses on immigration law for both businesses and individuals. Her practice includes filing applications for employment and family-based immigration with U.S. Citizenship and Immigration Service. Gretchen has extensive experience in counseling U.S. health care clients regarding the employment of foreign physicians and research scientists, and in North American Free Trade Agreement-based business immigration. She assists clients in obtaining both nonimmigrant and immigrant visas (L-1 intra-company transferee, O-1 outstanding ability, etc.) and files applications for nonimmigrant and immigrant visas with U.S. Consulates in foreign countries. She also provides legal representation for U.S. permanent residents applying for citizenship.

Gretchen’s clients include health care facilities and large multi-national corporations, as well as smaller U.S. and Canadian companies. She is a member of the American Immigration Lawyers Association.

Representative Experience

  • Obtained J waiver for a foreign physician to allow him to remain in the U.S. and work for large cancer research and treatment facility without having to complete a two-year home return requirement. Only 30 such waivers are available annually in New York State. 
  • Obtained approval of Blanket L-1 Petition for large multi-national company allowing them to expeditiously transfer critical foreign employees to related U.S. facilities. 
  • Obtained J-1 waiver for foreign physician allowing him to remain in the U.S. to work as an orthopedic surgeon for a large hospital system in Western New York without the necessity of fulfilling the usual two-year home return requirement.
  • Defended convenience store chain in criminal investigation by New York State Department of Environmental Conservation.
