A large regional power generating company faced a New York State audit of millions in economic development incentives on which the company depended to remain competitive in the market.
Our attorneys and professionals represented the company regarding the audit, which centered on the impact of a sale of ownership interest in the company some ten years earlier, and shortly after our client entered the incentive program. Coordinating with a national accounting firm, we took part in meetings and a series of correspondences with the state auditors.
We provided legal analysis to support the claim of incentives. Ultimately, we convinced the state to reinstitute $8 million in credits.
