Representing Emerging Technology Businesses’ Cross-Border Operations
Our attorneys have decades of experience helping Canadian and other non-U.S.-based emerging technology companies establish and develop their presence in the United States. We also help U.S.-based companies do business in other countries.
For example, a company with a promising medical technology funded by a foreign government’s venture capital fund engaged Barclay Damon to set up its U.S. operations and subsidiary. Our attorneys provided all of the documents and agreements necessary to launch the business in the United States, including employment agreements, founders agreements, and distribution and sale agreements. We helped the company resolve compliance and immigration issues and clarified complex New York State incentive programs.
In another instance, a sole proprietor developed and was selling a unique device that uses recycled materials for road maintenance. Our Emerging Technologies team assisted with the formation of the company and with trademark clearance and protection. We also helped develop a variety of distribution and representation agreements for U.S. and Canadian operations.
