Patent Infringement Claim Settled
Barclay Damon defended a Global 500 company against patent infringement claims brought in the Eastern District of Texas. The patent-in-suit concerned processes used to manufacture pharmaceuticals. The plaintiff, a patent-holding company owned by one of the named inventors, acquired the patent-in-suit from a former equipment supplier of our client that went out of business. After some setbacks in connection with claim construction, and after having been deposed over the course of two days, the inventor, on behalf of the plaintiff, agreed to settle the case for what amounted to nuisance value for our client.
