Counseling Facilities Spared Big Fines Based on Faulty Statistics

An outpatient substance abuse counseling facility faced the threat of massive, retroactive penalties from the Office of the Medicaid Inspector General (OMIG) following an audit that, the state claimed, found violations.

Our attorneys negotiated penalty reductions that resulted in minimal penalties. Our attorneys also filed a pre-hearing brief in the Department of Health administrative proceeding that challenged the way officials had used statistics to justify the large fines. That forced OMIG to drop nearly all of its negative findings.

When a second outpatient substance abuse counseling facility found itself in a similar situation, our attorneys used their experience to negotiate dramatic reductions in penalties and filed a pre-hearing brief that caused OMIG to again drop nearly all of its negative findings.
