Firm Successfully Defends Electric Power Generator

We successfully represented a large electric power generator, with nuclear power generation facilities located in Upstate New York, in litigation commenced in the United States District Court for the Northern District of New York by 18 former employees. In the lawsuit against their former employer and their union, the employees asserted claims of misrepresentation, breach of duty of fair representation, violation of section 301 of the Labor Management Relations Act, and breach of fiduciary duty under the Employee Retirement Income Security Act. After extensive discovery, the Court granted summary judgment in favor of the employer, as well as the union.
