BARCLAY DAMON DEFENDS LARGE MEDICAID TRANSPORTATION PROVIDER FROM OMIG SANCTIONS
When a large Westchester County-based Medicaid transportation provider faced a series of extreme sanctions from the Office of the Medicaid Inspector General, they turned to Barclay Damon to help save their business. A team lead by Linda J. Clark represented the client in an administrative appeal of an exclusion and termination action and sought a refund of a $2,100,000 recoupment of funding. The exclusion action would have placed lifetime bans on involved individuals and permanent bans on the entity and its affiliates from participating in state and government programs. An administrative law judge issued a groundbreaking decision to reverse the exclusion and the state’s recoupment, rejecting OMIG’s approach to audits and reviews and clearing the business of accusations of unacceptable practices.
